Agreement to Terms
By downloading, installing, or using the Talkative application ("App", "Service"), you ("User", "you") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Gyatam ("we", "us", "our").
If you do not agree to these Terms, you must not download, install, or use the App.
Your continued use of the App after any modification to these Terms constitutes your acceptance of the revised Terms.
Description of Service
Talkative is a voice-calling mobile application designed to help adults in India improve their spoken English by connecting them in real-time with live conversation partners. The Service includes:
Eligibility
3.1 Age Requirement
We do not knowingly collect personal data from anyone under the age of 18. If we become aware that a user is under 18, their account will be immediately terminated and all associated data permanently deleted.
3.2 Geographic Availability
The App is currently designed and optimised for users in India. By using the App from outside India, you acknowledge that certain features (OTP delivery, subscription pricing, language variety of partners) may not function as intended, and you do so at your own risk.
3.3 Technical Requirements
You are responsible for ensuring you have a compatible Android device and a stable internet connection. Minimum supported Android version: API Level 12 (Android 3.1). The App requires access to the microphone for voice calling.
Account Registration & Security
4.1 Registration
To use the Service, you must register with a valid Indian mobile phone number. You will receive a one-time password (OTP) via SMS to verify your number. You agree to provide accurate, current, and complete information at the time of registration and during onboarding.
4.2 Single-Session Policy
Talkative enforces a single-device session policy. Logging into a new device will automatically terminate any existing session on your previous device. You are responsible for all activity that occurs under your account.
4.3 Account Security
Your session is protected by a JSON Web Token (JWT) stored in Android's hardware-backed Keystore. You must not share your phone, OTP, or login session with any other person. We are not liable for any loss arising from unauthorised access to your account that results from your failure to maintain the security of your device or credentials.
4.4 Account Accuracy
You must not impersonate any person or use a false name, age, or identity when creating your profile. Providing false age information to circumvent the 18+ eligibility requirement is a material breach of these Terms and may result in immediate account termination.
4.5 One Account Per Person
You may maintain only one Talkative account per phone number. Creating duplicate accounts to evade a suspension, reputation penalty, or these Terms is strictly prohibited.
User Conduct & Community Rules
5.1 Purpose of Use
You agree to use Talkative solely to practise spoken English in a respectful and constructive manner. The App connects you with strangers who are attempting to improve themselves. You agree to engage in good faith.
5.2 Prohibited Conduct
You must not, while using the App:
Content & Communication
Use abusive, offensive, discriminatory, or hateful language based on race, religion, gender, caste, sexual orientation, or any other characteristic
Sexually harass, threaten, or intimidate any user
Share, request, or solicit any sexual, pornographic, or adult content through any means available in the App
Impersonate any other person, public figure, or entity
Platform Abuse
Accept a call and then remain silent, disconnect immediately, or otherwise waste your partner's time ("ghosting")
Repeatedly cancel partner searches excessively (more than 3 unjustified cancellations per 5-hour window results in a temporary match suspension)
Create multiple accounts to circumvent suspension or reputation consequences
Solicit any personal information (home address, financial details, real-time location) from a conversation partner
Use the App to advertise, promote, or sell any product, service, or scheme; or engage in fraud, scamming, or social engineering
Technical Abuse
Attempt to reverse-engineer, decompile, or disassemble any part of the App or backend infrastructure
Use automated scripts, bots, or software to interact with the Service
Attempt to intercept, tamper with, or record any WebRTC audio stream
Introduce malware, viruses, or any harmful code into the App or its backend
5.3 Profile Content
Your profile photo and name must be:
Rating, Reputation & Suspension System
6.1 Post-Call Ratings
After every call, you may rate your conversation partner on a scale of 1 to 5 stars and select up to 3 behavioral tags. You may also provide written feedback (maximum 500 characters). Ratings are final and cannot be changed after submission. You agree to rate your partners honestly and in good faith.
6.2 Reputation Score
Each user has a visible reputation score (ranging from –10 to +10) derived from ratings received. Consistently poor behaviour leads to a declining score; consistently good behaviour raises it.
6.3 Automatic Suspension
6.4 Cancel Abuse Suspension
Repeatedly cancelling matching searches excessively (more than 3 cancellations per 5 hours) will result in a temporary suspension from the matching queue, to protect partners from users who match and immediately disconnect.
6.5 Account Termination
For severe violations (harassment, hate speech, sexual misconduct, fraud, platform manipulation), we reserve the right to permanently terminate your account without prior notice and without refund of any unused subscription.
Subscriptions, Billing & Refunds

Prices are inclusive of all applicable taxes and may be revised from time to time with prior notice. Continued use after a price change constitutes acceptance.
7.3 Promotional Offer
🎁 First 1000 Subscribers — 1+1 Free
Limited to 1,000 eligible subscribers; one claim per account. Eligibility verified server-side at time of purchase. Promotion ends automatically once slots are claimed.
7.4 Google Play Billing
All payments are processed exclusively through Google Play Billing. We do not receive, store, or process your payment card details. All billing disputes are governed by Google Play's policies.
7.5 Subscription Renewal
Paid subscriptions do not auto-renew. You must manually repurchase a plan when your subscription period ends. You will be shown the paywall when your subscription expires.
7.6 Refund Policy
Refund requests are subject to Google Play's refund policy. For issues arising from a verified technical failure on our platform, contact us at talkative.krishna@gyatam.com.
No refund will be issued for:
7.7 Fraud Prevention
Each Google Play purchase token is stored with a UNIQUE constraint to prevent payment fraud and replay attacks. Attempting to reuse or transfer a purchase token is a violation of these Terms.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:
Intellectual Property
9.1 Our Property
All content, design, source code, trademarks, logos, and other intellectual property in the App ("Talkative IP") are the exclusive property of Gyatam or its licensors. Nothing in these Terms transfers any ownership of Talkative IP to you. You may not copy, modify, distribute, sell, or create derivative works without our prior written consent.
9.2 Your Content
You retain ownership of your name, profile photo, and written feedback. By submitting such content, you grant us a non-exclusive, royalty-free, worldwide licence to store, display, and use that content solely for operating the Service (e.g., displaying your photo to your call partner). We will not use your profile photo for advertising or share it with third parties.
9.3 Feedback
If you submit suggestions or ideas about the App, you grant us a perpetual, irrevocable licence to use that feedback without compensation or attribution.
Third-Party Services
The App relies upon the following third-party services. Your use of these is subject to their respective terms:

We are not responsible for the acts or omissions of these third parties, nor for any outage, data loss, or policy change on their platforms.
Disclaimers
11.1 No Warranty
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED. WE DO NOT WARRANT THAT:
11.2 User Interactions
You interact with other users at your own risk. We do not verify the identity of users beyond OTP phone number verification and do not screen or pre-approve user behaviour.

11.3 No Language Guarantee
Talkative provides the opportunity and infrastructure to practise English. We do not guarantee any improvement in your English language skills as a result of using the App.
Limitation of Liability
To the fullest extent permitted by applicable Indian law:
Nothing in this section limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Gyatam and its officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
Account Termination
14.1 Termination by You
You may delete your account at any time via Settings → Delete Account. Account deletion is immediate and permanent. All your data, including call history, profile photo, and subscription records, will be permanently erased. No partial refund is provided for unused subscription time.
14.2 Termination by Us
We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have:
Upon termination by us for cause, you forfeit any remaining subscription time without compensation.
14.3 Effect of Termination
Upon termination for any reason, your right to use the App ceases immediately. Sections 9 (Intellectual Property), 12 (Limitation of Liability), 13 (Indemnification), 15 (Governing Law), and 16 (Dispute Resolution) shall survive termination.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of India, including:
Dispute Resolution
16.1 Informal Resolution
We request that you first attempt to resolve any dispute informally by contacting us at talkative.krishna@gyatam.com with a clear description of your issue. We will make reasonable efforts to resolve it within 15 business days.
16.2 Jurisdiction
If the dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts of India, with the courts having geographical jurisdiction over the registered place of business of Gyatam having primary jurisdiction.
16.3 Consumer Rights
Nothing in this section affects your statutory rights as a consumer under applicable Indian consumer protection law, including the right to approach the relevant Consumer Disputes Redressal Forum.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you either by a prominent notice within the App before your next sign-in, or via an in-app push notification.
The "Last Updated" date at the top of this document will always reflect the most recent revision. Continued use of the App after changes are posted constitutes acceptance. If you do not agree to revised Terms, you must discontinue use and delete your account.
Miscellaneous
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gyatam with respect to the App and supersede all prior agreements.
18.2 Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
18.3 No Waiver
Failure by us to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.
18.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms without restriction in connection with a merger, acquisition, or sale of assets.
18.5 Language
These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
